The subject of Military Pensions has remained a labyrinth. Not just for the claimants and beneficiaries, but also for those in the establishment. What has further complicated the matter is the plethora of rules, regulations, letters and instructions which makes this subject quite unwieldy and confusing.
And then there are judicial pronouncements, many of which have not been incorporated in policy and are applied only to the litigants who approach Courts and Tribunals. To the credit of the successive governments, the pensionary provisions in India have been quite liberal with a high degree of benefit of doubt to claimants, though their interpretation at times has been literal and narrow at the hands of those handling entitlements.
Needless to state, there is lack of a common platform wherein important letters are consolidated as a compendium. There is also a dearth of a simple commentary on various pensionary concepts in the military, some of which are unique to the defence services and not applicable on civilian employees and retirees. Though we have come a long way from the Army Pension Regulations, 1940 to the 7th Central Pay Commission and the ‘One Rank One Pension’ scheme applicable today, the distance has not been one which was easy to navigate.
